An application for remedy order filed by B and C shall be dismissed respectively.

On May 11, 2018, the Defendant was sentenced to imprisonment with prison labor for one year and six months for a crime of fraud in Gyeyang Branch of the Suwon District Court on May 11, 2018, and on October 31, 2018 during the execution of the sentence, the Defendant was sentenced to one month of imprisonment with prison labor for a crime of fraud in the same court and completed the execution of the said sentence on July 29, 2019.

At around 15:00 on August 16, 2019, the Defendant made a false statement to the victim B, who posted a letter to the F bulletin board, an Internet medium-sized trading website, stating that he/she would face 256gg of Maribuk Protocol 256g on deposit of money.

However, the defendant did not have any intention or ability to send the above beer proton, even if he did not have 256 g of the beer prone, and even if he received the payment from the victim.

Nevertheless, on August 16, 2019, the Defendant, as seen above, by deceiving the victim, received 960,000 won from the G account (H) in the name of the Defendant, and acquired 32 times total of 18,37,100 won, such as the attached list of crimes (1).

On August 22, 2019, the Defendant reported that “The victim I purchased a cell phone on the bulletin board of “J”, which is an Internet site, and falsely told the victim that “I will send the cell phone to post offices if you send money.”

However, the fact that the defendant did not possess the above mobile phone and was willing to use it for the purchase of game money or the cost of living with money from the victim, so even if he received money from the victim, he did not have the intent or ability to send the above mobile phone to the victim.

Nevertheless, the Defendant deceiving the victim as above and received 374,000 won from the K account under the name of the Defendant as the sales proceeds of the same day from the victim.

Accordingly, the defendant deceivings the victim and is equivalent to KRW 374,00.
