A. The Plaintiff is a small president, other contracting business, and human resources supply business.

Defendant E is registered as the representative director of Defendant B (hereinafter referred to as “Defendant B”) from February 15, 2013 to November 18, 2013; from May 27, 2014 to October 19, 2015; and Defendant D as the representative director of Defendant B from May 27, 2014 to May 10, 2016.

B. On December 7, 2016, the Plaintiff supplied human resources to Defendant B, but did not receive the price, the Plaintiff drafted a certificate of confirmation as follows (hereinafter “certificate of confirmation of this case”) with the Defendants, and the following contents of the certificate of confirmation:

Defendant C (hereinafter “Defendant C”), Defendant D, and Defendant E signed or sealed each of the certificates of this case as joint and several sureties.

Account payable for personnel expenses: The amount above KRW 209,868,083 is confirmed as the current amount in commercial transactions on October 30, 2016, and promise to implement the following provisions:

Amount due: 114,750,690 won (hereinafter referred to as “F”) interest on the amount due from May 1, 2016 to November 30, 2016: 28,000,000 won (hereinafter referred to as “amount due”)

1. Of the above confirmed amount of KRW 209,868,00,000,000 shall be paid separately until April 30, 2017, and the principal shall be paid in equal amount of KRW 15,000,000 each month from December 30, 2016.

2. The interest at the time of default shall be ten percent (10%) per annum from December 1, 2016.

5. Defendants D and E representing Defendant B, the subject of the obligation, verify personal guarantee and jointly and severally stand joint and several sureties.

In addition, C also operated by D shall be joint and several sureties.

6. The above amount shall be individually and severally guaranteed in the same manner as 5 in respect of any outstanding amount arising after October 30, 2016, and C shall also be jointly and severally guaranteed.

7. From May 1, 2016, the amount of interest 28,000,000 won was not paid from May 1, 2016 to November 30, 2016.
