1. Defendants shall be punished by imprisonment with prison labor for one year and six months.
2. However, this judgment has become final and conclusive against the Defendants.
Punishment of the crime
Even if the Defendants were not the authorized person handling narcotics, they dealt with marijuana as follows.
1. The Defendants’ co-principal
A. The Defendants, around September 2017, are gathered to purchase and smoke marijuana, and Defendant A conspired to take the role of ordering marijuana by accessing the “D” website, which is a multilateral web specializing in the transaction of marijuana, and Defendant B, and Defendant C conspired to take part in the purchase price for marijuana and to take part in the collection of marijuana carried out by the seller of marijuana.
Defendant
A around September 27, 2017 according to the above public offering, from the F Building G, the Defendant’s residence in the Nam-gu Incheon Metropolitan City, sent to the said D website, and expressed his intention to purchase marijuana, and purchased approximately 1.784BC (limited to KRW 13,218,58 won in total) by transmitting the purchase price for marijuana to the e-mail address of the said seller, 0.094BC (limited to KRW 407,952 in Chinese currency) at the e-mail address of the said seller, and then purchased it by finding 3 g of marijuana which the said seller concealed in the detailed location from March 18, 2019, from that time to March 18, 2019.
B. On March 19, 2019, at around 01:00, the Defendants conspired to smoke in marijuana, and smoke in the music work room of Defendant B on the second floor of the building in Bupyeong-gu Incheon, Incheon, and the second floor, by drilling a small hole on the front side of the container of plastic coffee beverages, cutting approximately 1.63g of the marijuana purchased by the same method as indicated in the [Attachment Table No. 41] No. 41 on the surface of the container of plastic coffee beverages, and then sticking with a fire as soon as possible, thereby spreading the smoke.
2. Defendant A and Defendant C’s co-offenders agree to purchase marijuana in the same manner as described in paragraph (1). On March 19, 2019, around 17:11, the purchase price for marijuana is 0.07BTC (Korean in KRW 290,035) at the e-mail address of the seller of marijuana in the name of the seller of marijuana.
