The prosecution against the defendant is dismissed.
1. On September 9, 2017, the Defendant: (a) boarded a bus of 3000 that is operated by the victim B from the gold village to the Incheon bank; (b) resisted that the bus was long; and (c) made a claim against the victim that the bus was long; (d) made a verbal dispute with the victim; and (e) made the victim’s victim’s “I am late,” and made a public insult of the victim’s “I am late,” among other passengers.
2. The facts charged in the instant case are the crimes falling under Article 311 of the Criminal Act, and may be prosecuted only when the victim files a complaint pursuant to Article 312(1) of the Criminal Act.
According to the records of this case, the victim may recognize the fact of revoking the complaint against the defendant on June 12, 2018, which was after the prosecution of this case. Thus, the public prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
