The prosecution of this case is dismissed.
Reasons
1. On February 5, 2013, at around 03:10 on February 5, 2013, the Defendant assaulted the victim D(19 years of age) at “Cjuk” located on the 2nd floor of the Gyeonggi-si, Gyeonggi-si, Seoul-si, with kneee.
2. The above facts charged cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(2) of the Criminal Act. According to the records, on March 20, 2013, after the prosecution of this case, the victim expressed his/her intent not to punish the defendant, the prosecution of this case is dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act. It is so decided as per Disposition.
