1. The Defendant shall pay to the Plaintiff KRW 371,358,318 and the interest rate of KRW 12% per annum from August 21, 2019 to the date of full payment.
1. The Plaintiff, as indicated in the claim, supplied various kinds of bit leased goods to C in accordance with the goods supply contract concluded with C (hereinafter “C”) on November 29, 2016, but did not receive the total amount of KRW 371,358,318.
However, as the Defendant jointly and severally guaranteed C’s obligation to pay for the goods (including outstanding bills) under the above goods supply contract on November 29, 2016, the Defendant is obligated to pay to the Plaintiff 371,358,318 won and the amount calculated by the rate of 12% per annum from August 21, 2019 to the date of full payment, which is the day following the delivery of the copy of the instant complaint.
2. Article 208 (3) 3 of the Civil Procedure Act (Judgment by public notice) of the applicable provisions of Acts;
