The defendant is an individual entrepreneur residing in the North Gun/Si of North Korea who runs a construction business with 20 full-time workers.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Provided, That the payment date may be extended by an agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay the amount of KRW 1,50,000 in October 2, 2015, which was retired from the said place of business from February 2, 1998 to October 31, 2015, within 14 days from the date of retirement without agreement between the parties on the extension of the payment deadline.

Nevertheless, the Defendant retired from office from office from February 7, 2015 to February 17, 2016 at the site of a new housing construction project in Gunsan-si, as well as KRW 2,210,000 in total of six workers, as shown in the separate crime list, did not pay 7,560,000 in total within 14 days from the date of retirement without agreement between the parties to the extension of the payment deadline.
