1. The original copy of the payment order of the Defendant’s Jeju District Court Decision 201Hu194 against the Plaintiff was issued.
1. Indication of Claim: C on September 30, 1996, sold books equivalent to KRW 1,640,000 to the Plaintiff.
On June 2, 2005, on the premise that C transferred the above payment claim to the Defendant, the Defendant filed an application for payment order against the Plaintiff with the Jeju District Court No. 201th and 194 of Seopo-si, Seopo-si, 201. The payment order became final and conclusive around that time.
However, before the above payment order is requested, the above payment claim has already been extinguished by prescription.
Accordingly, the plaintiff became entitled to the claim of this case to exclude the executory power of the original of the above payment order.
