The defendant shall be innocent.

Reasons

1. On September 24, 1998, at around 23:51 on September 24, 1998, B, an employee of the defendant, operated in a state where water source was loaded at a height of 4.23 meters on the street in front of the national highway No. 1 National Highway 1 located in Gero-si, in violation of 4.0 meters high in restriction on operation of vehicles. 2. The penal provisions applied to a summary order subject to review are the Constitutional Court Order 2010Hun-Ga38 (Merger) Decided October 28, 2010, 201Hun-Ga24, December 29, 201, and 201Hun-Ga20, 2011Hun-Ga21 (Merger), and 201Hun-Ga, October 25, 2012, 2012, and thus, the defendant loses its effect retroactively by the former part of the Criminal Procedure Act.
