1. The judgment of the court of first instance is justifiable even if the defendant, citing the judgment of the court of first instance, examined the newly submitted evidence in consideration of the allegations and reasons supplemented by the court of first instance.
Therefore, the reasoning of this court’s judgment is identical to the reasoning of the first instance judgment, except where “0.025%” in the second part of the second part of the judgment of the court of first instance is deemed to be “2.5%,” and thus, it is acceptable in accordance with the main sentence of Article 420 of the Civil Procedure Act
2. In conclusion, the judgment of the first instance is just, and the defendant's appeal is dismissed.
