피고인은 부산 부산진구 C에서 D 모텔이라는 상호로 숙박업을 영위하는 사람으로, 주식회사 에스엠유티와 성인 전용 포르노 영화가 방영될 수 있도록 하는 위성방송 시스템 설치계약을 하고 위 모텔에 위성 수신기를 설치하여, 2013. 6. 10.경 위 모텔 내 객실에서 성명불상의 손님들로 하여금 남녀가 나체로 성교하는 장면, 나체의 남녀가 오럴섹스를 하는 장면 등 음란한 내용이 담긴 일본 포르노 영화를 관람하게 하였다.
