피고인은 2020. 5. 14. 23:15경 서울 금천구 B 앞 노상에서 ‘술에 취해 길을 막고 있다’는 112 신고를 받고 출동한 금천경찰서 C파출소 소속 경장 D가 피고인에게 차량 통행을 위해 길 옆으로 비켜줄 것을 요청하자 이를 거부하고 순찰차의 뒷좌석에 무단으로 탑승하려고 하여 경장 D가 이를 제지하자 “짭새들이 돈을 받았냐.”라고 욕설을 하며 경장 D를 밀치고, 이후 순찰차 앞을 가로막아 다시 경장 D가 이를 제지하자 경장 D의 몸통 부위를 밀치며 저항하여 약 15분 동안 위 순찰차가 C파출소로 귀환하지 못하게 하여 경찰공무원의 국민의 생명ㆍ신체 및 재산의 보호에 관한 정당한 직무집행을 방해하였다.
