구상금등 청구의 소
1. Defendant B’s KRW 84,112,200 and as to the Plaintiff’s KRW 6% per annum from March 26, 2019 to April 24, 2019, and April 25, 2019.
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. Pursuant to Article 3(1) main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings (wholly amended by Presidential Decree No. 29768, May 21, 2019 and enforced June 1, 2019) and Article 2(2) of the Addenda of the same Act, the part of the Plaintiff’s claim for payment of damages for delay exceeding the rate of 12% per annum from June 1, 2019 among the Plaintiff’s claim is dismissed.
However, the costs of lawsuit shall be borne by the Defendants by applying Article 98 and the proviso to Article 101 of the Civil Procedure Act.
