1. The defendant shall pay to the plaintiff 40 million won with 12% per annum from March 18, 2020 to the day of complete payment.
According to Gap 1 and 3, it is recognized that the Plaintiff: (a) leased C Apartment D from the Defendant on January 9, 2016 to January 14, 2018 at the time of residing in Gyeongbuk-gu; and (b) paid a deposit of KRW 40 million to January 14, 2016; and (c) on May 17, 2019, the Plaintiff agreed to receive KRW 40 million with the Defendant by August 31, 2019.
Therefore, the defendant is obligated to pay to the plaintiff 40 million won deposit and damages for delay at the rate of 12% as stipulated by the Act on Special Cases concerning Expedition, etc. of Legal Proceedings from March 18, 2020 to the day of full payment, which is the day following the delivery of the complaint of this case filed by the plaintiff.
If so, the plaintiff's claim is justified.
