The defendant's appeal is dismissed.
1. The summary of the grounds for appeal did not rhym the victim’s left her, and thus, the court below found the Defendant guilty of the facts charged in the instant case in error of mistake of facts.
2. In light of the judgment, the defendant led to confession of the crime of indecent act by force at the court of the court below as to the crime of indecent act by force at the time of original adjudication, there are no circumstances to suspect the voluntariness of confession, and there are no new evidences to prove this, and there are no new circumstances to reverse it at the court of the first instance, the court below's finding the defendant guilty of the charges of this case based on the evidence at the time
3. Therefore, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act, since the defendant's appeal is without merit. It is so decided as per Disposition.
