1. The Defendant shall pay to the Plaintiff KRW 20,80,000 and the interest rate of KRW 15% per annum from July 2, 2015 to the day of complete payment.

Reasons

1. Basic facts

가. 원고는 2011. 4. 20.경 피고와 사이에, 피고가 제주시 C에 있는 건물 1층을 임차하여 운영하고 있던 ‘D’이라는 웨딩� 점포(이하 ‘종전 점포’라고 한다)를 권리금 1억 2,000만 원에 인수하기로 하는 계약(이하 ‘이 사건 점포인수 계약’이라고 한다)을 체결하고, 피고에게 계약금으로 2011. 4. 20. 500만 원, 2011. 4. 21. 2,500만 원, 2011. 5. 18. 2,000만 원, 합계 5,000만 원을 지급하였다.

B. On May 25, 2011, the Plaintiff requested the Defendant to cancel the instant store acceptance contract, and the instant store acceptance contract was rescinded.

C. On October 23, 2012, the Plaintiff received KRW 4.2 million from the Defendant.

2. Determination

A. As seen above, in light of the fact that the Plaintiff returned KRW 4,20,000,000,000, which was paid as the down payment of the contract for the purchase of the instant store by the Defendant on October 23, 2012, and the content of the evidence Nos. 3, 4, and 5, the Plaintiff and the Defendant agreed to receive the contract for the purchase of the instant store around May 25, 201. The Plaintiff and the Defendant agreed to receive the refund of KRW 25,00,000,000 out of the down payment already paid by the Defendant at the time of the termination of the contract for the purchase of the instant store.

Therefore, barring any special circumstance, the Defendant is obligated to pay to the Plaintiff the down payment of KRW 20.8 million (=25 million - 4.2 million) and damages for delay calculated at the rate of 15% per annum from July 2, 2015 to the day of full payment, as the Plaintiff seeks.
