(2) Article 208(3)2 of the Civil Procedure Act applicable mutatis mutandis to the provisions of this case (the judgment of confession made by non-appearance, the defendant appears to have applied for individual rehabilitation to the Busan District Court as of the present date on the grounds of economic difficulties. The defendant's application for individual rehabilitation does not prohibit any creditor's litigation to secure title solely on the fact that the defendant applied for individual rehabilitation. Even if this judgment becomes final and conclusive, if the repayment plan is authorized through individual rehabilitation procedure, the defendant can pay the plaintiff the debt in this case according to the authorized repayment plan.
