A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. The Defendant engaged in the work of occupational embezzlement from around July 201 to July 2014 in the work of managing materials and supplying mobile phone semi-finished products to the customer company in D, a corporation operated by Osan City B and C with the second floor of 203.
Around 15:00 on May 2, 2014, the Defendant cited 179 semi-finished goods, which are mobile phone devices, to supply plastics, at the office of the said victim D Co., Ltd., the Defendant did not deliver the above semi-finished goods, which are likely to be returned from the business partner company due to the damage of the above semi-finished goods, but did not return them to the victim company, and left them at the place that is not left in the snow, and later disposed of voluntarily. At that time, the Defendant left the above semi-finished goods under the direction of the stairs of the dormitory parking lot of the said company.
As a result, the Defendant embezzled semi-finished goods in a way that refuses to return the total amount of KRW 21,862,794.
2. A thief, around 07:25 on July 10, 2014, the Defendant: (a) 179 mobile phone semi-finished goods, which were left alone in the stairs of the underground parking lot of the D dormitory of the said company, as described in the above paragraph (1) within plastic materials storage; (b) 179 mobile phone-finished goods, which the said Defendant, at the victim company’s business partner, stolen parts of the mobile phone stored in the said victim company’s warehouse and assembled them to put them into a mobile phone, and then, (c) intended to deliver the said corporation Company A to plastics; and (d) 180 mobile phone-processed parts of the mobile phone loaded in the said material warehouse between the above F, etc. entering the said warehouse and loaded in the said location (13:107 won per opening); (b) 200 scalker 200 (2,350 won per opening); and (d) 179 179 mobile phones (14:179,476 billion won per piece of the mobile phone).
