피고인은 2018. 5. 3. 21:17경 서울 마포구 소재 자택에서 B에 접속하여 ‘D’ 제목의 뉴스 기사에 ‘개먹튀 인성 더럽고 술담배에 쩐 돼지색귀.ㅋㅋㅋㅋㅋ’라는 댓글을 작성하여 고소인을 공연히 모욕하였다.
