A. The prime Pamper Co., Ltd. entered into a contract with the Defendant to supply the amount of 1,974 boxes of sugar products to the Defendant in KRW 108,570,000, which are functional health foods, and supplied it to the Defendant on January 6, 2014.

On December 10, 2014, Won Pampa Co., Ltd. transferred to the Plaintiff the claims remaining KRW 89,545,000, out of the purchase price claims under the above contract (hereinafter “instant purchase price claims”), and notified the Defendant of the assignment of claims by mail proving the same day.

B. Since then, the defendant paid an additional amount of 50,490,000 won, but still remains.

Therefore, the Defendant is obligated to pay to the Plaintiff the amount of KRW 50,490,000 in the remainder of the price and the damages for delay calculated at the rate of 5% per annum from October 23, 2014 to July 20, 2016, the delivery date of a copy of the instant complaint, and 15% per annum from the next day to the date of full payment.

The defendant's argument as to the defendant's assertion asserts that the original Pamper Co., Ltd. or the plaintiff secured sales places so that they can sell the non-saleed products at KRW 15,000 per 1 gambling, and that they would help sell them at KRW 55,00,00, by deceiving the defendant to force him to leave the products, and that he created and transferred the claim to the defendant as if he sold at KRW 55,00 per gambling.

However, there is no specific assertion or proof that conforms to the above detailed deception argument, and the defendant did not attend the preparation date of the case and the date of pleading more than three times.

Therefore, the defendant's above assertion is not accepted.

3. The plaintiff's claim for conclusion is justified and it is so decided as per Disposition.
