The litigation costs for retrial shall be borne by the plaintiff.

Although the Plaintiff (Plaintiff) asserts to the effect that there exists a cause for a retrial under Article 451(1)9 of the Civil Procedure Act in the judgment subject to a retrial, the materials submitted by the Plaintiff (Plaintiffs) alone cannot be recognized as constituting a cause for a retrial as alleged in the judgment subject to a retrial, and there is no evidence to acknowledge that there exists a cause for a retrial under Article 451(

Therefore, the retrial costs are dismissed, and the costs of retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
