A defendant shall be punished by imprisonment for not less than eight months.
Punishment of the crime
On October 11, 2013, the Defendant was sentenced to six months of imprisonment for a violation of the Act on Specialized Credit Financial Business in Busan District Court, and completed the execution of the sentence on May 4, 2014.
1. Embezzlements of deserted articles in possession;
A. On April 11, 2016, around 01:30 on April 11, 2016, the Defendant acquired a Chapter 1 Samsung New World Card, which was owned by the victim E, in front of D located in Busan Shipping Daegu C.
Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, and he embezzled the above card with his own idea without taking necessary procedures.
B. On April 15, 2016, around 17:00, the Defendant found one copy of the Cze Card of the Korean Bank, the victim H was lost in the vicinity of G parking lot located in Busan Shipping Daegu F.
Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, and he embezzled the above card with his own idea without taking necessary procedures.
2. Violation of Acts in financial business specializing in fraud and credit;
A. On April 11, 2016, around 01:59, the Defendant purchased goods of the amount of KRW 7,300,00 in total from the J convenience store located in Busan, Daegu, Busan, and offered the Victim K who manages the above convenience store as if he was his card, and subsequently, offered the Samsung New World Card acquired as described in the above paragraph 1-A to the victim K, who purchased the above convenience store, as if he was his card, and used the lost credit card.
B. On April 11, 2016, at the above J convenience store around 02:01, the Defendant purchased goods with a total of KRW 28,400,00 in the value of the 11th class market, and offered the victim K who manages the above convenience store as if he was his card, and subsequently, offered the Samsung New World Card acquired as indicated in the above paragraph 1-A to the victim K as if he was his card, and used the lost credit card.
