피고인은 2012. 10. 7. 1:45경 성남시 수정구 B 편의점에서 성명불상자로부터 위 편의점의 종업원인 C과 물건 가격으로 시비가 있다는 신고를 받고 출동한 성남수정경찰서 D파출소 소속 순경인 피해자 E이 112신고 처리 중에 팔짱을 낀 모습을 보고, 피해자에게 “팔짱 풀어 좆같은 새끼야. 나이도 어린 새끼가 어디서 좆같이 행동해. 씨발새끼들, 너희가 민중의 지팡이냐.”고 큰소리로 말하여 위 C 등 4명이 있는 자리에서 공연히 피해자를 모욕하였다.
