1. The case where the National Labor Relations Commission applied for reexamination of unfair labor practices on March 17, 2017.

Reasons

1. Causes and contents of the decision in the retrial;

A. The Plaintiff (hereinafter “Plaintiffs Union”) is an industrial trade union under the National Press Trade Union, which is established with the organization of employees engaged in nationwide media industries and related businesses, and is working for approximately 840 workers belonging to the Defendant Intervenor (hereinafter “ Intervenor Company”).

The intervenor company is a company that employs approximately 1,830 full-time workers and engages in broadcasting business, cultural service business, etc.

B. On June 13, 2016, the Plaintiff Mutual Aid Association rejected Plaintiff Mutual Aid Association’s employees (Secretary), F, and G’s distribution of labor reports (hereinafter “instant act of distribution”), asserting that it obstructed Plaintiff Mutual Aid Association’s execution division H and I’s distribution of labor reports on March 14, 2016 (hereinafter “instant act of photographing”) and that it obstructed Plaintiff Mutual Aid Association’s distribution of labor reports on April 19, 2016 (hereinafter “Plaintiff Mutual Aid Association’s unlawful distribution of labor reports”) from Plaintiff Mutual Aid Association’s employees on March 23, 2016, 206, < Amended by Presidential Decree No. 27135, Mar. 23, 2016; Presidential Decree No. 27153, Mar. 31, 2016; Presidential Decree No. 27156, Apr. 26, 2016>

C. On November 18, 2016, Seoul Regional Labor Relations Commission rendered a decision dismissing part of the above relief to the effect that “(3) and (4) prohibited distribution in the Labor Relations Commission’s report constitutes unfair labor practices, but the remaining activities do not constitute unfair labor practices.”

Plaintiff

A union and a participant company were dissatisfied with the above determination and filed an application for review with the National Labor Relations Commission, and the National Labor Relations Commission applied for review on March 17, 2017 for review of unfair labor practices.
