Defendants jointly and severally liable to the Plaintiff for 397,750,000 Won and its weight:
(a) As regards 293,800,000 won, January 1, 2020
1. Indication of claims: To be as specified in attached Form 1;
2. Grounds for recognition;
(a) Defendant B: Judgment deemed to be a confession (Article 208(3)2 of the Civil Procedure Act)
(b) Defendant C: Judgment by publication service (Article 208(3)3 of the Civil Procedure Act);
3. The part dismissing part of the Plaintiff claimed damages for delay calculated at the rate of 12% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings against Defendant C from May 1, 2020 to the date of delivery of a copy of the complaint. However, the interest rate under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings applies from May 1, 2020 to the date of delivery of a copy of the complaint of this case. Thus, the Plaintiff recognized damages for delay calculated at the rate of 6% per annum under the Commercial Act from May 1, 2020 to October 9, 2020, which is the date of delivery of a copy of the complaint of this case, and 12% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the next day to the date of full payment.
