1. At the same time, the defendant receives KRW 100,000,000 from the plaintiffs, and at the same time, the building stated in the attached list to the plaintiffs.

Reasons

1. Basic facts

가. 피고는 소외 D과 사이에 D 소유의 별지 목록 기재 건물(이하 ‘이 사건 건물’이라 한다)의 1층 점포 149.74㎡ 및 1층 일반음식점 40.26㎡ 중 별지 도면 표시 2, 3, 12, 13, 2의 각 점을 차례로 연결한 선내 ㈏부분 15평(이하 ‘이 사건 점포’라 한다)에 관하여, ① 2002. 10. 31.경 임차보증금 1억 원, 월 차임 220만 원, 임차기간 2002. 10. 1.부터 2005. 9. 30.까지(이후 2008. 9. 30.까지로 갱신됨)로 하는, ② 2008. 10. 31.경 임차보증금 1억 원, 월 차임 220만 원, 임차기간 2008. 10. 31.부터 2011. 10. 30.까지로 하는, ③ 2011. 10. 31.경 임차보증금 1억 원, 월 차임 220만 원, 임차기간 2011. 10. 31.부터 2013. 10. 30.까지로 하는 각 임대차계약(이하 2011. 10. 31.자 임대차계약을 ‘이 사건 임대차계약’이라 한다)을 체결하였다.

B. The Plaintiffs purchased the instant building from D around March 20, 2014 and completed the registration of ownership transfer on May 8, 2014 with respect to the Plaintiff A’s share 2/3, and Plaintiff B’s share 1/3, respectively.

C. On May 26, 2014, Plaintiff B sent to the Defendant a content certificate that seeks the delivery of the instant store on the ground that the lease contract for the instant store was terminated due to the expiration of the period, and the renewal of the contract was impossible (hereinafter “content certificate”). The said content certification was served on the Defendant around that time.

2. The parties' assertion

A. The Plaintiffs’ assertion ① the instant lease agreement was terminated on October 30, 2013, and ② even if the instant lease agreement was explicitly renewed, Article 639 of the Civil Act provides that the lessee shall continue to use the leased object and benefit therefrom after the expiration of the lease term.
