1. Basic facts
A. The defendant is a dedicated elderly employment agency established for the purpose of contributing to the promotion of green welfare such as the development and distribution of jobs suitable for the abilities and aptitudes of the aged under Article 23-2 of the Welfare of Older Persons Act. The defendant is entrusted by the Minister of Health and Welfare with the receipt of an application for a job-seeking business, decision on subsidies, execution and management of the business.
B. On December 2014, the Korea Senior Animal Association (hereinafter “Korea Senior Animal Association”) established the Plaintiff and created a companion animal complex of 2,020 square meters (hereinafter “instant place of business”) with three stories at the Seoul Dae Park General Information Center (hereinafter “the instant place of business”), the Korea Senior Animal Association (hereinafter “Korea Senior Animal Association”) filed an application for subsidies of KRW 257,00,000 with the Defendant to employ senior citizens aged 60 or older (one person, 2014, 1, 2015, 22, 2016, 66, 2017, 200, while submitting a plan for the business (hereinafter “instant business”).
C. The Plaintiff was established on December 12, 2014, and was designated by the Minister of Health and Welfare as an elderly-friendly enterprise on December 15, 2014.
On December 18, 2014, the Plaintiff, the Defendant, and the companion Animal Business Association entered into an implementation contract for the aged-friendly enterprise (hereinafter referred to as the “instant contract”). The main contents of the agreement are as follows.
Article 1 (Purpose) The purpose of this Agreement is to provide for relevant matters necessary for the establishment of an elderly-friendly enterprise and the promotion of support projects between the defendant (hereinafter referred to as "A") and the companion Animal Business Association (hereinafter referred to as "B") and the plaintiff (hereinafter referred to as "disease") established under the implementation contract for response investment.
Article 2 (Contents of Business) A and C shall cooperate in and implement the following projects:
(b) Business contents: Animal-related educational business / convenience facility provision business / human service provision business;
C. A project period: December 16, 2014 to December 31, 2017.
