The defendant shall be innocent.
Reasons
1. On June 11, 1993, at around 21:24 on June 11, 1993, an employee of the Defendant violated the restriction on vehicle operation by operating a freight vehicle belonging to the Defendant in excess of the weight.
2. Of Article 86 of the former Road Act (amended by Act No. 4545, Mar. 10, 1993; Act No. 4920, Jan. 5, 1995), the part concerning a violation under Article 84 subparagraph 1 of the same Act, which applies to a summary order subject to review, ceases to have effect retroactively with the decision of unconstitutionality as of December 29, 201 by the Constitutional Court, and thus, the Defendant is acquitted pursuant to the former part of Article 325 of the Criminal Procedure Act.
