피고인은 2014. 5. 20. 01:10경 인천 부평구 B 앞 노상에서 폭행을 당했다는 112신고를 받고 현장에 출동한 경찰관인 피해자 C(남, 37세) 에게 “이 씨발새끼들아, 개새끼들아 니들 다 옷벗을 줄 알아”라고 욕설을 하며 피해자의 얼굴을 혀로 핥는 등 시민 20여명이 보는 앞에서 공연히 피해자를 모욕하였다.
