Defendant shall be punished by a fine of one million won.
If the defendant does not pay the above fine, KRW 100,000.
Punishment of the crime
On September 2012, the Defendant: (a) received a proposal from the victim C, the representative director B, to open a exhibition center in Vietnam through “the proposal to operate the Korea Exemplary Products Exhibition; and (b) made it possible to pay KRW 10,000 for each product if Korean small and medium enterprise products are displayed in Vietnam; and (c) decided to lease three floors of buildings in Vietnam, which are located in D, around November 2012, to open the exhibition center.
1. On November 2012, the Defendant defraudation in the name of Indian cost: “Around 2012, the Defendant shall transfer KRW 10,000,00 to the victim’s account (F) of the E-I Bank (hereinafter “E”) at the Hano-si in Vietnam, Hano-si.”
However, since the Defendant was in need of urgent living expenses other than exhibition screening expenses, even if he paid high-amount fees to the above E, he did not transfer 10,000 won to the above account to the victim. Thus, even if he received remittance from the victim as a human test expenses, he did not intend to use it as a test fee for exhibition hall.
On November 22, 2012, the Defendant received 10,000 won from the victim to the above account as the expenses for the test, and received 8,900 dollars excluding the fee from the above E, and paid 85,000 dollars to G who is the tethical business operator, and used 400 dollars 1,60 ( approximately 431,600) as the living expenses of the Defendant.
Accordingly, the defendant was given property by deceiving the victim.
2. On January 4, 2013, the Defendant sent the e-mail stating that “The Defendant shall purchase a cooling machine, a kitchen, a counseling table, a water purifier, and other phrases, etc. to the victim in the foregoing market, and send the e-mail stating that “The Defendant shall purchase a cooling machine, a kitchen, a counseling table, a water purifier, and other phrases, etc. to the victim, and the operating expenses shall require a little amount of 2,00 dollars.”
However, even if the defendant receives money from the victim for additional expenses, he/she shall also receive money from the victim.
