However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. The Defendant and C are married couple.

On September 12, 2014, at around 01:30 on September 12, 2014, the Defendant, without a driver’s license for a car, was on a bridge, a rail, and a median margin, while driving a car in the vicinity of the Rabbbbban IC in the Gyeonggi-gu, Gyeonggi-do.

As above, the Defendant: (a) received an accident that occurred while driving the said automobile without a driver’s license; and (b) conspired with C to receive the insurance money for the said traffic accident on September 18, 2014, with the concerns that C would not pay the insurance money for the said traffic accident; (c) received a report from the victim (on the part of the victim) marine fire insurance; and (d) received the report from C on September 18, 2014; and (c) submitted to the said victim’s employees a written claim for the payment of the automobile insurance money and the written statement of the accident to the victim that C would have caused the traffic accident while driving the said vehicle; and (d) submitted the said written claim for the payment of the automobile insurance money and the written statement of the accident to the victim to the victim’s employees, the victim paid KRW 11,690,000 to the Agricultural Cooperative account under the Defendant’s mother’s account (F) with the Defendant paid KRW 3,080,000.

Accordingly, the defendant, in collusion with C, obtained a reasonable amount of vehicle repair cost after deceiving the victim, and acquired the pecuniary benefit of avoiding the payment of the rental cost.

2. On September 12, 2014, the Defendant, at around 00:45, driven a car volume without a car driver’s license, from around 01:30 on the same day, from the front side of the t&n cp spice sprink, which was located in the Hagu-dong, Ansan-si, Ansan-si, Ansan-si to the roads adjacent to the Gyeonggi-gu, Gyeonggi-do, where a traffic accident as referred to in the above paragraph (1) occurred, at around 60 kilometers from the same day to the roads adjacent to the spice site.
