The action for retrial shall be dismissed.
The litigation costs for retrial shall be borne by the plaintiff (the plaintiff, the selected party).
According to the records, the plaintiff (the plaintiff and the designated party) filed a request for retrial on the same or similar ground as the lawsuit of this case, and received the dismissal judgment. Thus, the lawsuit of this case is deemed to have been repeatedly filed on the same or similar ground as the previous request for retrial, and thus, it is inappropriate to permit it as it constitutes an abuse
Therefore, the litigation for retrial is dismissed, and the costs of retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices.
