The Defendant, as an internal director of the company D in Suwon-gu, Busan, performed the management of the sales agency of the officetel in Busan, Daegu Etel from March 2013 to August 2015. On July 26, 2013, the Defendant entered into a lease agreement with the victim F and the above officetel 102 Dong 1903 with the lease deposit amount of KRW 100 million on August 9, 2013.

After that, the Defendant knew that the right to lease on a deposit basis was not established at 102 dong 1903, the said officetel, and tried to arbitrarily cancel the registration of the right to lease on a deposit basis established by means of pretending that the right to lease on a deposit basis was delegated by the injured party.

1. On August 20, 2013, the Defendant forged a private document: (a) at a sales agency office located on the first floor of Busan Shipping Daegu Etel in Busan, Busan, and (b) around August 20, 2013, the Defendant had the F’s seal, proxy form, and documents necessary for cancelling the registration of the establishment of a right to lease on a deposit basis at the office above.

G was delegated by the F to cancel the registration of the right to lease on a deposit basis with the said F, and the proxy was prepared and the registration of the right to lease on a deposit basis was finalized.

G, who is aware of the fact on the same day, had the purport to delegate the act of filing an application for registration in the office above the same day, enter the name "Seng-gu Busan Metropolitan City E 102 Dong 1903, Busan Metropolitan City E 1903" in the indication column of the real estate using mixix on the letter of delegation printed, "H, 2807, and F" in the column of the mandator, and affix the F seal received from the defendant to his name.

Accordingly, the defendant, for the purpose of exercising authority, forged a letter of delegation in the name of F, a private document related to rights and obligations.
