피고인은 2013. 3. 28. 18:15경 경북 청도군 C에 있는 피해자 D이 운영하는 E식당 앞에서 주차하려고 하였을 때 피해자로부터 “장사집 앞에 주차하면 안된다”라는 말을 듣고 화가 나 샷시공장 직원들, 이웃사람이 듣고 있는 가운데 피해자에게 “지 땅도 아니면서, 씨발! 잘먹고 잘살아라!”고 큰소리로 욕설을 하는 등 공연히 피해자를 모욕하였다.
