1. The Defendants jointly and severally liable to the Plaintiff KRW 40,000,000 and Defendant B with respect thereto from February 28, 2013, and Defendant C.

Reasons

1. The premise is: (a) around May 201, Defendant B entered into a sales contract on the size of 22,215 square meters (hereinafter “instant land”) of the F forest land in the Dolsan-si, the Plaintiff’s general affairs E and the Plaintiff’s Dolsan-si (hereinafter “instant land”); and (b) deposited the down payment of KRW 20 million in the Plaintiff church account on May 18, 201.

② On May 19, 2011, Defendant B provided E with convenience to complete complete transfer of the land of this case on the register with respect to KRW 70,000,00,000 as the addressee of the Plaintiff church, and provided Defendant B with convenience to complete complete transfer on the register. Defendant B concluded on May 19, 201, taking into account the buyer’s circumstances, made full payment by August 14, 201.

(3) On May 23, 2011, E, who has been in charge of the Plaintiff’s account, returned KRW 20 million to Defendant C from the Plaintiff’s account. ④ On June 28, 2011, the Plaintiff completed the registration of transfer of ownership on the ground of the sale on June 1, 201, and reported the sales price of KRW 50 million to Defendant B as the purchase price of the instant land after the expiration of the payment period stipulated in the instant guarantee certificate, and Defendant B filed a complaint against Defendant B for fraud. 6: (i) Defendant B filed a complaint against the Plaintiff on the charges of KRW 20 million with the Plaintiff’s account; (ii) Defendant B received the payment of KRW 1,00,000 from the Plaintiff’s account; and (iii) Defendant B received a criminal complaint against each of the aforementioned charges of KRW 1,201,000,000 from the Central31.

2. According to the facts of recognition prior to the determination of the cause of the claim, the Plaintiff and Defendant B, via E representing the Plaintiff, on May 19, 201.
