A and B shall be punished by imprisonment with prison labor for one year, for four months, and for a fine of 5,00,000 won, respectively.

1. Defendant A

A. On April 25, 2013, the Defendant filed an application for a corporate general facility loan with the J, a party employee of the Plaintiff’s National Bank I located in Nam-gu Incheon Metropolitan City H at the I branch of the Victim’s National Bank I, and the Defendant is KRW 594,00,000.

In this regard, a loan for construction cost is received.

The standard contract for private construction works, stating the construction cost of KRW 594,00,000, while making a false statement, was submitted.

However, in fact, the construction cost of the said newly constructed construction was KRW 495,000,000, and the standard contract for private construction works, stating the above KRW 594,00,000, was prepared in a false way to obtain a large amount of loans.

As above, the Defendant deceivings the victim as above, and 144,00,000 won around April 25, 2013; 110,000,000,000 won around May 31, 2013; 120,000,000 won around June 28, 2013; and 28,875,000 won around August 5, 2013; 290,00,000,000 won around August 6, 2013; and 290,00,00,000 won around December 24, 2013; and 48,125,000 won under the name of the national bank in the name of K (L:) by taking out the loan account number; and

B. On January 24, 2014, the Defendant: (a) prepared a false statement of accusation with respect to B at the E-Attorney Office located in the Nam-gu Incheon Metropolitan City, Incheon, by mail; and (b) submitted it to the Incheon, Incheon, Police Station; (c) on February 18, 2014, at the Incheon, the investigation of the Incheon, Incheon, and at the intelligence team office, made a supplementary statement on the complaint.

The details of the complaint are as follows: “The Construction Corporation for the New Construction of Korea Logistics Center” under the title of “the Construction Corporation for the Construction Work”, “the Construction Corporation, N outside Incheon Si-Gun,” “the date of commencement, April 1, 2013,” “the date of completion scheduled”, “the contract amount of KRW 30,000,000”, “the contract amount of KRW 333,000,000”, “the contract deposit”, “the contract deposit amount of KRW 165,00,000,000”, and “the amount of KRW 165,000,000” at the bottom of the document.
