The prosecution of this case is dismissed.
Reasons
1. 공소사실의 요지 피고인은 2020. 9. 16. 00:55 경 인천 서구 B에 있는 C 앞 도로 상에서 내연관계였던 피해자 D(53 세, 남) 을 찾아와 “ 이 씨 발 새끼야, 걸레 같은 새끼야. ”라고 크게 소리치며 손등으로 피해자의 가슴 부위와 머리 뒷목 부분을 때리고 발로 허벅지를 3회 걷어찼다.
Accordingly, the defendant assaulted the victim.
2. According to the records, it is recognized that the victim expressed his/her intention not to have the punishment against the defendant after the prosecution of this case.
Therefore, the public prosecution of this case is dismissed in accordance with Article 327 subparagraph 6 of the Criminal Procedure Act.
