Defendant shall be punished by imprisonment for a term of one year and six months.
However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Around 02:10 on April 23, 2014, the Defendant assaulted the victim’s face by taking advantage of the victim’s D(30 years of age) on the street in front of Ulsan-gu, Ulsan-gu, Seoul-gu, and having arrived at the victim’s D (30 years of age) in front of the said residence, and then demanding the payment of taxi expenses from the victim, taking the victim’s face one time by drinking, and taking the victim’s shoulder part once by drinking.
2. At around 02:20 on April 23, 2014, the Defendant illegally using a motor vehicle: (a) the victim left the said taxi driver’s seat in order to avoid assault by the Defendant, such as paragraph (1) above; (b) the victim left the said taxi driver’s seat without the consent of the victim; and (c) arbitrarily boarded the 500 meters away from the said taxi without the consent of the victim and temporarily used the motor vehicle of the victim who is the right holder.
3. Around 02:20 on April 23, 2014, the Defendant: (a) driven a victim’s Eststyna taxi, and start the taxi from the street in front of Ulsan-gu Seoul to the docheon-si; and (b) the victim opened a door to the driver’s seat in order to restrain it, and even if the part was even found, the Defendant started the above taxi, thereby driving the taxi, which is a dangerous object for the victim who was unfured from the driver’s seat, and led about about 10 meters.
As a result, the defendant used dangerous objects to inflict bodily injury on the victim, such as the surface of a bridge, which requires medical treatment for about two weeks.
4. Around 02:20 on April 23, 2014, the Defendant was driving the said taxi under the influence of alcohol from the front day of Ulsan-gu C to the front day of the Ulsan-gu Samsan-dong, Ulsan-gu, Busan-do, Seoul-do.
Accordingly, the defendant was arrested by a police officer who was dispatched to the site after receiving a report 112 and was arrested as a flagrant offender due to the above traffic accident, and was transferred to the F Zone of the Ulsan Southern Police Station.
