1. The Defendant shall pay to the Plaintiff KRW 60,082,150 and interest rate of KRW 20% per annum from March 31, 2015 to the day of complete payment.
On June 14, 2014, the Plaintiff entered into a contract with the Defendant to lease new construction materials at the road construction site between the East Sea-styles. From around that time to January 2015, the Plaintiff’s lease of new construction materials equivalent to KRW 87,071,090 for the above site is recognized as either there is no dispute between the parties or according to the purport of the entire pleadings, and on the other hand, the fact that the Plaintiff received KRW 26,98,940 from the Defendant’s rent from the Plaintiff is the Plaintiff.
Therefore, the defendant is obligated to pay to the plaintiff the unpaid rent of KRW 60,082,150 and damages for delay calculated at the rate of 20% per annum from March 31, 2015 to the day of full payment, which is the day following the day when the copy of the complaint of this case was served to the defendant, as requested by the plaintiff.
Therefore, the plaintiff's claim is justified and it is so decided as per Disposition.
