On February 1, 2013, the Defendant was sentenced to imprisonment with prison labor for fraud, etc. at the Seoul Central District Court for two years and six months and 54,600,000 won, and the said judgment became final and conclusive on April 11, 2013 by a judgment dismissing the appeal against the above judgment.

Around August 4, 2007, the Defendant conspired with C, and around August 4, 2007, purchased at the “E” coffee shop located in Gangnam-gu Seoul Metropolitan Government, the victim F and G with the purport that “it is possible to purchase a parking building in Yong-gu H with a higher price than the market price or the officially announced land price. It is possible to obtain an appraisal report with an appraiser affiliated with the IEE corporation with a pro rata corporation with a higher price of at least 5 billion won, and loan at least 6.5 billion won from the financial right. Accordingly, if a building is purchased with a loan, it would be deducted from the cost of the loan. To carry out the loan, it shall be issued first, and if 100 million won is lent as necessary for the issuance of an appraisal report, it shall be issued with the borrowed amount, and it shall be repaid at least 6.5 billion won with a loan of at least 6.5 billion won at the latest.”

However, even if the victims borrowed money from the victims, they did not have the intention or ability to repay the principal and interest by borrowing 6.5 billion won from the financial right as collateral until the agreed due date.

Nevertheless, as seen above, the Defendant, by deceiving the victims as above with C, received a total of KRW 100 million from two occasions on August 6, 2007 to a passbook under the name of C from the victims, and acquired it by fraud. < Amended by Act No. 8557, Aug. 14, 2007; Act No. 70 million won on August 14, 2007.
