In addition to each part of the instant real estate in this case, the seller may reimburse the seller the sum of the down payment and the buyer may waive the down payment and rescind this contract until the buyer pays the intermediate payment (if there is no intermediate payment, the remainder) to the seller under Article 5 (Cancellation of Contract).
Article 6 (Non-performance of Obligations and Compensation for Damages) If the seller or the purchaser has defaulted on the terms and conditions of this Agreement, the other party may notify in writing the person who has defaulted on the contract and rescind the contract.
In addition, the parties to the contract may claim damages for the cancellation of the contract respectively to the other party, and the contract deposit shall be considered as the basis for damages, unless otherwise agreed.
- The buyer shall be assigned to the present condition.

A. On September 20, 2017, the Plaintiff entered into a real estate sales contract (hereinafter “instant sales contract”) with respect to the Defendant’s share among the Defendant and the Incheon po-gun C, 1,322 square meters of land and D 1,322 square meters of land and E 322 square meters of land, with respect to the purchase price of KRW 970 million, the down payment of KRW 30 million, the remainder amount of KRW 30 million, and the remainder amount of KRW 94 million on October 30, 2017, with the following content.
On the same day, the Plaintiff paid 30 million won the down payment to the Defendant.
B. The Defendant would confiscate the down payment of KRW 30 million to the Plaintiff and cancel the contract unless the remainder is paid by December 6, 2017, “by November 30, 2017” to the Plaintiff.
“The proof of the content” shall be the same.
