1. The plaintiff's main claim is dismissed.
2. The defendant shall be located on the plaintiff with the area of 419 square meters in Jinandong-gun, Jinandong-gun and 281 square meters in D.
1. Judgment on the plaintiff's primary claim
가. 원고는 이 사건 주위적 청구원인으로, 1988. 8. 12. 피고 앞으로 일괄적으로 소유권이전등기(☞ 등기부상 등기원인 : 각 “1987. 1. 2.자 협의분할에 의한 재산상속”)가 마쳐진 이 사건 토지는 원래 원고의 선친으로서 피고의 할아버지인 망 E(이하 편의상 ‘고인’이라고 한다)의 소유였는데, 고인이 1976. 2.경 사망한 다음, 1976. 3. 20.경 고인의 공동상속인들 사이에 이 사건 토지를 원고의 단독소유로 하기로 하는 내용의 상속재산 분할협의가 이루어졌다고 주장하면서, 피고를 상대로 이 사건 토지에 관하여 그 상속재산 분할협의를 원인으로 한 소유권이전등기절차의 이행을 구한다.
B. Since the division of inherited property through consultation is effective only with the consent of all co-inheritors. If some of co-inheritors give no consent or some of them are defective in the power of representation, the agreement on division of inherited property shall be deemed null and void (see, e.g., Supreme Court Decision 2001Da28299, Jun. 29, 2001). On March 20, 1976, we examine whether the agreement on division of inherited property asserted by the Plaintiff was reached with the consent of all co-inheritors of the deceased person about whether the agreement on division of inherited property was reached on March 20, 197, and whether the agreement on division of inherited property was made with the consent of the deceased person's co-inheritors, and some of the statements written by the witness A, witness Gap's testimony and the result of the written appraisal commission on the appraiser's funds of this court, and there is no other evidence to acknowledge this. Thus, the plaintiff's primary assertion is not acceptable.
2. On March 20, 1976, the judgment of the Plaintiff’s conjunctive claim is based on the following: (a) some of the entries or images of the Plaintiff’s conjunctive claim; (b) witness A’s testimony; and (c) the entire purport of the pleadings as a result of the on-site inspection conducted by this court; and (d) from among the co-inheritorss of Goman around March 20, 1976, immediately after the Plaintiff’s death.
