가. 피고인은 2014. 10. 11. 09:00경 파주시 C에 있는, 피해자 D이 경영하는 ‘E식당’에서, 마치 정상적으로 돈을 낼 것처럼 행세하며 피해자에게 뼈찜, 막국수, 소주 1병, 맥주 1병 등을 주문하였다.

가. 피고인은 2014. 9. 28. 22:00경 서울 구로구 M, 102호에 있는, 피해자 N이 운영하는 ‘O식당’에서, 마치 정상적으로 돈을 낼 것처럼 행세하면서 피해자에게 해물모듬볶음 1접시, 소주 1병 등을 주문하였다.
