1. The first instance judgment, including the claims expanded and reduced in this Court, shall be amended as follows:

(i).

Reasons

1. The summary of the case and the facts premised on the case

A. The summary of the instant case pertains to the Plaintiff’s claim for payment of KRW 12,945,254,703, including rent, etc., by asserting that the Plaintiff did not receive rent, facility management entrustment cost, value-added tax, taxes and public charges, and facility management expenses, while leasing a commercial building to the Defendant under a lease agreement with the Defendant.

The judgment of the court of first instance accepted a set-off claim against the plaintiff, with the claim for return of unjust enrichment equivalent to 25 billion won against the plaintiff, which falls under the lease period exceeding 20 years against the plaintiff, and dismissed all the plaintiff's claim. The plaintiff and the defendant appealed against this claim, and thereafter the defendant withdrawn the appeal by this court.

(B) The plaintiff revised the amount of facility management fees in this court, excluded the portion of television receiving fees from the tax and public charges claims, and added the amount of late payment in proportion to the rate of 17% per annum as stipulated in the lease agreement, thereby expanding and reducing the claim.
