1. The plaintiff's claim is dismissed.

Reasons

The objection to a final and conclusive judgment may be raised only when the cause of objection arises after the closing of argument in the previous lawsuit (Article 44(2) of the Civil Execution Act). Since all of the claims cited by the Plaintiff as the cause of objection in this case are apparent by itself that it was arising before the closing of argument in the previous lawsuit, the claim in this case is unnecessary to examine the legitimacy of the judgment in the previous lawsuit.
