1. The Defendant shall pay to the Plaintiff KRW 25,00,000 and the interest rate of KRW 15% per annum from November 26, 2016 to the day of full payment.
According to the statements in Gap evidence Nos. 1 and 2, the defendant may recognize the fact that he/she agreed to return KRW 25 million to the plaintiff on or around June 2013 as the borrowed money. Thus, the defendant is obligated to pay to the plaintiff damages for delay calculated at the rate of 15% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from November 26, 2016 to the day of complete payment, which is the day following the delivery of a copy of the complaint in this case.
The plaintiff's claim is justified and it is so decided as per Disposition.
