A defendant shall be punished by imprisonment for not more than ten months and by a fine not exceeding 3,00,000 won.
When the defendant does not pay the above fine.
Punishment of the crime
The Defendant is the owner of the business in Dongdaemun-gu Seoul Metropolitan Government, and the “C” marina business in the first floor above the ground.
1. On March 11, 2019, the Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (the Act on the Punishment of Commercial Sex Acts, Etc.) committed a similar sexual intercourse in a manner that, around March 11, 2019, the Defendant: (a) installed two drinking places in a place of marina; (b) 90,000 won in return for sexual traffic from the customer who found the place of the said place; and (c) assisted the female employee D to engage in a similar sexual intercourse with the female employee, such as the said D, in return for sexual traffic, from around March 2017 to March 11, 201, by having the customer who demanded sexual traffic among the unspecified multiple customers, receive KRW 90,00 in return for sexual traffic; and (d) provided such similar sexual intercourse with the female employee as above.
Accordingly, the defendant committed commercial sex acts such as arranging commercial sex acts.
2. No person who violates the Educational Environment Protection Act shall operate a business establishment banned from access by and employing juveniles, which provides services that are likely to engage in physical contacts between unspecified persons, exposure to confidential parts, etc. or to engage in other similar activities in an educational environment protection zone for the purpose of protecting the health, sanitation, safety, learning, and educational environment of students;
Nevertheless, from June 22, 2018 to March 11, 2019, the Defendant engaged in sexual contacts or sexual intercourse with unspecified persons, such as providing services that are likely to result in sexual acts, such as exposure to the sealed part, or similar acts, at the Mazzzzy site located within the educational environment protection zone located within 137.8m in a straight line from the boundary of the F Elementary School located in Dongdaemun-gu Seoul Metropolitan Government, Dongdaemun-gu, and installing two rooms equipped with bed, and doing so.
