1. Defendant B’s KRW 6,581,590 for the Plaintiff and KRW 5% per annum from September 18, 2015 to August 30, 2016.

Reasons

1. Basic facts

A. The parties concerned are those who purchased from Defendant B the D Apartment No. 106, 1301 (hereinafter “the apartment of this case”) in Incheon Dong-gu, Incheon, and Defendant B sold the apartment of this case to the Plaintiff, and Defendant C is the spouse of Defendant B.

B. 1) The instant apartment was completed on or around June 2003, and Defendant B acquired the ownership of the instant apartment around May 2013 and resided together with Defendant C in the instant apartment. (2) On April 3, 2015, the Plaintiff visited the instant apartment that the Defendants reside with the employees of the F Licensed Real Estate Agent Office in Dong-gu Incheon Metropolitan City to build the instant apartment around 18:00.

3) On April 14, 2015, the Plaintiff, around April 14, 2015, intended to purchase the instant apartment from Defendant B and Defendant B with KRW 218 million (hereinafter “instant sales contract”).

)을 체결하였고, 계약 당일 피고 B에게 계약금 2,180만 원, 2015. 7. 1.경 잔금 1억 9,620만 원을 각 지급하였으며, 2015. 7. 4.경 이 사건 아파트에 입주하였다. 4) 원고와 피고 B 사이에 작성된 2015. 4. 14.자 이 사건 아파트에 관한 매매계약서에 첨부된 중개대상물 확인ㆍ설명서 중 ‘대상물건의 상태에 관한 자료요구 사항’란에 “중개업자의 요구에 따라 매도의뢰인이 ⑨~⑫항을 확인 및 고지하고, 매수의뢰인이 인지한 후 계약을 체결함”이라고 기재되어 있고, ‘⑪ 벽면 및 도배상태‘란에는 “벽면 균열 없음, 벽면 누수 없음”이라고 기재되어 있다.

2. Determination as to the claim against the defendant B

A. The summary of the parties' assertion 1 is that there are serious defects in the apartment of this case of the plaintiff 1, such as spawn, water leakage, and mycoin, so the defendant 2 is a seller, and Article 580 of the Civil Act is a seller.
