The judgment of the court below is reversed.

Reasons

1. The offense of violation of the Act on the Protection of Children and Juveniles against Sexual Abuse is an offense, the statutory penalty of which is imprisonment for a term of not less than one year or a fine of not less than 5 million won but not more than 20 million won, and the lower court’s judgment on the instant case is an offense under the jurisdiction of a collegiate panel, but is an offense of violation of jurisdiction.
