On November 9, 2017, the Defendant was sentenced to two years of imprisonment with prison labor for special intimidation at the Seoul Southern District Court on Seoul Southern District Court on November 9, 2017, and is currently under suspension of execution as of November 17 of the same month.

피고인은 2018. 3. 31. 06:10경 서울 영등포구 B에 있는 피해자 C(여, 71세)이 운영하는 식당에 들어간 후 그곳 손님이 약 4명 있는 상황에서 이전에 그 식당에서 소란을 피운 적이 있다는 이유로 피해자로부터 나가라고 제지를 당하자 식당 문 앞에서 피해자에게 욕설을 하며 오른손으로 피해자의 왼쪽 손목을 잡아당겨 피해자를 넘어지게 하고 피해자로부터 뺨을 1회 맞자 이에 화가 나 피해자의 멱살을 잡고 욕설을 하다가 경찰관이 출동하였음에도 피해자에게 욕설을 하고 피해자를 때리려는 시늉을 계속하였으며 불이 붙어 있는 담배꽁초를 피해자를 향해 던지는 등 소란을 피움으로써 약 30분 동안 위력으로써 피해자의 식당 영업 업무를 방해함과 동시에 피해자를 위와 같이 폭행하였다.
